Agreement to Terms

By accessing and using Digli (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Digli is a mobile application that uses AI-powered image recognition to identify vinyl album covers and help users catalog their music collections. The service includes:

• Album cover recognition using camera or photo upload
• Metadata retrieval from Discogs, Apple iTunes, and Spotify
• Personal collection management (Dig Pile, Shelf, Want List)
• AI-generated album reviews and recommendations
• Album sharing capabilities

User Accounts

Account Creation

To use Digli, you must create an account using a valid email address. You are responsible for:

• Maintaining the confidentiality of your authentication codes
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

Account Eligibility

You must be at least 13 years old to use Digli. If you are under 18, you must have parental or guardian consent to use the App.

Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

Acceptable Use

You Agree To:

• Use the App only for personal, non-commercial purposes
• Photograph only legitimate album covers for recognition
• Comply with all applicable laws and regulations
• Respect intellectual property rights
• Provide accurate information when using the service

You Agree NOT To:

• Use the App for any illegal or unauthorized purpose
• Attempt to circumvent rate limiting or security measures
• Reverse engineer, decompile, or disassemble the App
• Use automated systems (bots, scrapers) to access the service
• Upload inappropriate, offensive, or illegal content
• Impersonate others or create fake accounts
• Interfere with or disrupt the App's functionality
• Attempt to gain unauthorized access to our systems
• Use the App to spam or harass other users
• Resell or redistribute our service without permission

Intellectual Property

Your Content

You retain ownership of photos you upload to Digli. By uploading photos, you grant us a limited license to:

• Process images through our AI recognition service
• Store images temporarily for recognition purposes
• Cache recognition results to improve service efficiency

We do not claim ownership of your photos and will not use them for any purpose other than providing the service.

Our Content

The App, including its design, features, code, and content (excluding user-generated content and third-party data), is owned by Digli and protected by copyright, trademark, and other intellectual property laws.

Third-Party Content

Album metadata, reviews, and artwork are provided by third parties:

• Discogs: Album information, track listings, release data
• Apple iTunes: Audio previews and album metadata
• Spotify: Track popularity data, album artwork, and links
• OpenAI: AI-generated album recognition and liner notes

We do not claim ownership of this third-party content. All rights belong to their respective owners.

Discogs Attribution

This application uses Discogs' API but is not affiliated with, sponsored or endorsed by Discogs. "Discogs" is a trademark of Zink Media, LLC. Data provided by Discogs.

Service Limitations

Recognition Accuracy

While we strive for high accuracy, AI-powered album recognition is not perfect. We do not guarantee:

• 100% recognition accuracy
• Complete metadata for all albums
• Recognition of rare, bootleg, or obscure releases
• Availability of all albums in Discogs or iTunes databases

Rate Limiting

To ensure fair usage and manage costs, we implement rate limiting:

• Currently: 50 recognition requests per hour per user
• Rate limits may change based on system capacity and abuse patterns
• Excessive usage may result in temporary or permanent account suspension

Service Availability

We strive to maintain 99% uptime but do not guarantee uninterrupted service. The App may be temporarily unavailable due to:

• Scheduled maintenance
• Server issues or technical problems
• Third-party API outages (OpenAI, Discogs, Apple iTunes, Spotify)
• Force majeure events

Privacy and Data

Your use of Digli is also governed by our Privacy Policy. By using the App, you consent to our data practices as described in the Privacy Policy.

Fees and Payment

Digli Pro: Digli offers a free tier with 10 record scans. After that, unlimited scans and Discogs collection import require a Digli Pro subscription. Connecting a Discogs account is free; running an import requires Digli Pro.

Pricing: Digli Pro is billed monthly through your Apple ID at the price shown in the App Store at the time of purchase. Prices may vary by region and are subject to change with notice where required by law.

Billing: Payment is charged to your Apple ID account. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple ID account settings.

Restore Purchases: If you reinstall Digli or switch devices, use Restore Purchases in Account settings to recover an active subscription.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be error-free or uninterrupted
• Warranties regarding the accuracy, completeness, or reliability of content
• Warranties that defects will be corrected

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGLI SHALL NOT BE LIABLE FOR:

• Indirect, incidental, consequential, or punitive damages
• Loss of data, profits, revenue, or business opportunities
• Damages arising from use or inability to use the App
• Damages resulting from third-party services (OpenAI, Discogs, Apple iTunes, Spotify)
• Damages from unauthorized access to your account

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim (currently $0 during beta).

Indemnification

You agree to indemnify and hold harmless Digli, its developers, and partners from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use or misuse of the App
• Your violation of any third-party rights
• Content you upload or share through the App

Third-Party Services

Digli integrates with third-party services subject to their own terms:

• OpenAI: Terms of Use
• Discogs: Terms of Service
• Apple iTunes: Terms and Conditions
• Spotify: Terms of Use

We are not responsible for the availability, accuracy, or terms of these third-party services.

Modifications to Service and Terms

We reserve the right to:

• Modify or discontinue the App (or any part thereof) at any time
• Update these Terms at our discretion
• Change rate limits, features, or pricing

Material changes will be communicated through:

• In-app notifications
• Email to your registered address
• Updates to this page with revised "Last updated" date

Your continued use after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada and the province in which Digli is registered, without regard to conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or your use of Digli shall be resolved through:

1. Informal Resolution: Contact us via Feedback in the Digli iPhone app (Account → Feedback) to attempt good-faith resolution
2. Mediation: If informal resolution fails, disputes may be submitted to mediation
3. Arbitration: Binding arbitration in accordance with applicable arbitration rules

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Digli regarding use of the App, superseding any prior agreements.
